Terms of Service

Acceptance

By downloading, accessing, or using BeWake, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use BeWake. You may use BeWake only if you can form a binding agreement and are allowed to use the app under applicable law.

Eligibility

BeWake is not for children under 13. If you are under the age of majority where you live, you may use BeWake only with permission from a parent or guardian. You may not use BeWake if you are barred from using the app under applicable law or if we have previously terminated your access for violating these terms.

Using BeWake

You are responsible for configuring alarms, choosing appropriate scan items, keeping your device charged, maintaining network access when required, allowing needed permissions, and using the app safely. BeWake may require camera, notification, and account permissions for core features.

License to use the app

Subject to these terms, BeWake grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the app for your own lawful personal use. You may not copy, modify, sell, lease, distribute, or create derivative works from BeWake except where applicable law gives you a non-waivable right to do so.

No safety guarantee

BeWake is a wake-up aid, not a medical, emergency, safety, security, or life-support service. We do not guarantee that an alarm will always ring, that notifications will always arrive, that audio will repeat outside the app, or that item verification will always be accurate. Do not rely on BeWake where failure could cause injury, missed medication, legal consequences, financial loss, or other serious harm.

Accounts

BeWake uses Sign in with Apple for account access. You are responsible for activity associated with your account and device. You must provide accurate information when required and must not access another person's account or interfere with account security. You can sign out or request account deletion from Settings in the app.

Camera scans and AI verification

By using scan features, you allow BeWake to capture and process scan images, verification metadata, and related technical information to determine whether the required item is visible. AI verification may be incorrect. You should use common sense when choosing items and avoid scanning sensitive, private, unsafe, or illegal content.

Feed and social features

If you use Feed, followers, following, replies, reposts, reactions, reports, or related features, you are responsible for the content and interactions you share. BeWake has no tolerance for objectionable content or abusive users. Do not post or transmit content that is illegal, abusive, hateful, harassing, threatening, sexually explicit, exploitative, deceptive, spam, invasive of privacy, infringing, or content you do not have the right to share.

Your content

You keep ownership of content you create. By sharing content through BeWake, you grant BeWake a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, transmit, process, moderate, and operate that content as needed to provide and improve the app. This license ends when the content is deleted, except where retention is needed for backups, safety, security, legal compliance, moderation, or dispute handling.

Moderation

We may remove content, hide posts, restrict features, suspend accounts, terminate access, or preserve information if we believe content or behavior violates these terms, creates risk, harms users, infringes rights, or may be unlawful. Users can report content, hide posts, block posters, and delete their own posts from the app. Reported content is flagged for review, and blocked posters are removed from the blocking user's Feed.

We may also preserve or disclose information when reasonably necessary to comply with law, respond to legal process, enforce these terms, investigate abuse, or protect BeWake, users, or the public.

Prohibited conduct

You may not misuse BeWake, reverse engineer the service, bypass security controls, overload infrastructure, scrape data, automate abusive activity, impersonate others, interfere with notifications or verification, submit malicious content, or use BeWake to violate law or third-party rights.

App Store terms

If you downloaded BeWake from the Apple App Store, Apple is not a party to these terms and is not responsible for BeWake or its content. Apple has no obligation to provide maintenance or support for BeWake. To the extent these terms conflict with the App Store Terms of Service, the App Store Terms of Service apply. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Third-party services

BeWake may rely on third-party services for authentication, backend hosting, AI verification, notifications, analytics, or distribution. We are not responsible for third-party services, and your use of those services may be subject to their own terms and privacy policies.

Service changes

We may update, suspend, restrict, or discontinue any part of BeWake at any time. We may also update these terms as the app evolves. Continued use of BeWake after changes means you accept the updated terms.

Disclaimers

BeWake is provided "as is" and "as available." To the fullest extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, uninterrupted operation, and error free operation.

Limitation of liability

To the fullest extent allowed by law, BeWake and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, missed alarms, missed events, personal injury, property damage, or reliance on app behavior. Our total liability for any claim relating to BeWake will not exceed the amount you paid to use BeWake in the 12 months before the claim, or 100 US dollars if no amount was paid.

Termination

You may stop using BeWake at any time. We may suspend or terminate access if you violate these terms, create risk, or use the app in a way that may harm BeWake, other users, or third parties. Sections that by their nature should survive termination will survive, including content licenses, disclaimers, liability limits, and dispute-related terms.

Governing law and disputes

These terms are governed by the laws of the State of California, without regard to conflict-of-law rules, unless your local law requires otherwise. You and BeWake will try to resolve disputes informally first by contacting the email below. If a dispute cannot be resolved informally, it may be brought in the state or federal courts located in California, unless applicable law gives you the right to bring it elsewhere.

Severability

If any part of these terms is found unenforceable, the remaining parts will remain in effect. Failure to enforce any part of these terms does not waive our right to enforce it later.
